If you want to rely on your General Terms and Conditions, they must meet the following conditions:

  1. You must declare your T&C's applicable, for example by declaring your T&C's applicable in the underlying documents such as a quotation or Assignment Agreement. 
  2. You must provide your T&C's by making your T&C's accessible to the other party. For example, you publish your T&C's on your website. 
  3. Your T&C's must be accepted. This may be done tacitly, for example because the other party does not reject your T&C's. 
  4. Your T&C's must not be unreasonable. Have your T&C's checked by one of our Legal Pros.
  5. Your T&C's must be understandable. For example, if you have customers from abroad, make sure you (also) have T&C's in English. 

Depending on your specific situation, you may want to take the following actions:
- If you offer B2B and B2C services or products, you may want to use 2 different kind of sets of T&C’s, one for each type of customer.
- You may want to keep your T&C's current and update them regularly.
- If you make amendments to your T&C's, you may need to notify your customers of these changes.
- You need to take action if the other party declares their T&C's to be applicable and send the letter Rejection T&C's.
