Privacy policy checklist

Make it Legal™ Checklist

Here are a few important steps to take to finish your document

Read the document to make sure it meets your needs. Remember that if you have any questions you can easily Ask a lawyer.

Make your Website Privacy Policy available to users of your website by placing a visible link in the footer section of every page that users can access.

The Website Privacy Policy is not a contract and does not need to be signed by website users. Users consent to the terms of this Policy by using your website.

A copy of your Privacy Policy will be stored automatically in your Rocket Lawyer account ‘Dashboard’.

You should also download and securely store a copy of your Privacy Policy for your records. If you later amend your Privacy Policy, you should store your new copy and keep a dated copy of each previous version of your Privacy Policy that has been in force. You should also maintain a record of when each version was introduced and how and when it was made available to your website’s users.

Group companies

Your business may share the information that your website collects with group companies (eg between a parent company and its subsidiaries) or affiliates (eg businesses which your business has control over, or which has control over your business). If you do so, consider attaching a schedule of group companies or affiliates to your Privacy Policy, as your customers and visitors have a right to know who has access to their information.

Cookies

If your website uses cookies, users must be given the opportunity to expressly consent to the use of cookies. You can do this by updating your website with a pop-up or message bar, which asks users to accept the use of cookies. Users must positively do something to consent to cookies (eg click a checkbox). This means that users are not considered to have consent just because they, for example, see a message about cookies and do not indicate that they don’t consent.

Additionally, you should add a link to your cookie policy (either a standalone Cookie policy or your Privacy Policy that includes a section on cookies and privacy) on every page of your website that collects personal information.
