Residency Requirements

At least one of the spouses must have lived in Oklahoma for 6 months, and he or she must also have been a resident for of the county where the divorce is filed for at least 30 days.

If a couple fulfills the residency requirements, then one of the spouses may file a petition for divorce. A petition for divorce has to be filed in the District Court of the county of residence either spouse. Once the Petitioner (the filing spouse) has filed for divorce it is their responsibility to serve their spouse, now called the Respondent. Service can be done through mail or hand delivery. Traditional 3rd party service is not necessary; however, the Respondent must sign a form that explains that he or she received the necessary papers and will file them with the court.

The Waiting Period and The Final Decree


If the couple has no children their divorce can be finalized in as little as 10 days; however with children and a few disputes it must take at least 90 days. The divorce is settled in a final divorce hearing that occurs in the court of the original county of filing. This hearing is not specific to the couple: uncontested divorces are handed out en masse.
