Question

My client only paid half—how can I get the rest?

They’ve gone silent after partial payment, even though the work is done and I have proof. What legal steps can I take now?

Rocket copilot

Answer

Many businesses begin by sending a formal demand letter that states the remaining balance, what was delivered, and a payment deadline. This also helps document your efforts.

If there’s no response:

  • Small claims court. If the amount fits your state’s limit, it’s often the fastest, least expensive option.
  • Civil lawsuit. For larger balances or complex terms, consider filing in a higher court.

Keep everything: invoices, emails, texts, delivery proofs, and any admissions. Strong documentation makes recovery more likely.

What to consider in your specific situation

Your options depend on the amount owed, your contract terms, and the strength of your records. Consider:

  • The total unpaid amount and contract type.
  • Your state’s small claims court limits.
  • Proof of completed work and partial payment.
  • Any communication about the remaining balance.
  • The cost and time of pursuing legal action.
