The Self-Proving Affidavit

The self-proving affidavit ("Proof of Will" in some states) is a document which should be signed in front of a notary public and attached to the end of the Will. The affidavit recites that the requisite formalities were observed in signing the Will.

Although attaching the affidavit has nothing to do with the legality of the Will itself, it can speed the admission of the Will to probate after the death of the Will writer because it eliminates the need to have a witness appear at the probate proceeding to testify that the formalities in signing the Will were followed. The witnesses may not be available later when they are needed. A self-proved Will may be admitted to probate without additional witnesses or affidavits, but it is still subject to contest on such grounds as undue influence, lack of testamentary capacity, or prior revocation.

In, witnesses to a will are not required to be disinterested, but if they are "interested", there is a rebuttable presumption that the witness received the will's benefit through fraud or other undue influence, unless there are two additional disinterested witnesses. If the interested witness can not rebut that presumption, they can not take more than they would have taken if no will had existed at all, if anything. The signature of an interested witness will count towards satisfying 's requirement that non-handwritten wills have two witnesses. . Many states require only two witnesses, but the signature of a third witness provides some protection against the possibility that one of the witness' signatures will be invalid for some reason. For example, a person should not be a witness if that person is a beneficiary under the Will. In most states, if a beneficiary's signature is counted in order to satisfy the minimum number of witnesses, then the Will is not necessarily invalidated, but that "interested witness" may not receive a share of the estate any larger than if the Will writer had died without a will. . Vermont requires three witnesses. The signature of a third witness provides some protection against the possibility that one of the witness' signature will be invalid for some reason.

  • How do I write a Will in Montana?

It is very simple to document your wishes with a free Montana Last Will and Testament template from Rocket Lawyer:

    1. Make your Will - Answer a few simple questions, and we will do the rest
    2. Send and share - Look over the document with an attorney, if desired
    3. Sign it - Optional or not, having two disinterested witnesses is ideal

This method, in most cases, will be notably more affordable and convenient than hiring and working with a conventional law firm. If needed, you can prepare this Last Will and Testament on behalf of an elderly parent, a spouse, or another family member, and then help them sign when ready. Please keep in mind that for a Will to be considered valid, the testator must be an adult who is mentally competent at the time of signing. If the testator is already incapacitated and unable to make their own decisions, a court-appointed conservatorship might be necessary. When facing this scenario, it is a good idea to speak with an attorney .

  • Who should write a Will?

Every person over 18 should have a Last Will and Testament. Even though it is difficult to acknowledge, your loved ones will want to know your wishes in relation to guardianship (if applicable), your assets, and/or property when you pass away. Here are some typical situations where you might consider it helpful to make or update your Will:

    • You have become a parent
    • Your marital status has changed
    • You own or recently sold/bought real estate
    • You are getting older or dealing with ongoing health issues

Whether your Montana Last Will and Testament has been drafted as part of a long-term plan or produced as a result of a change in your life, notarization and witnesses are strongly recommended for protecting your document if its legitimacy is doubted by a third party.

  • Should I work with an attorney to review my Will in Montana?

Writing a Will is normally straightforward, but you or your executor might still need legal advice. Seeking out an attorney to review your Will could take longer than you'd expect if you try to do it by yourself. An easier approach to consider is to get help via Rocket Lawyer attorney services. Premium members can request advice from an experienced attorney or pose other legal questions. As always, you can be confident that Rocket Lawyer is here by your side.

  • How much would I normally need to pay to make a Will in Montana?

The fees associated with finding and working with a legal provider to make a Last Will and Testament could total between two hundred and one thousand dollars, depending on where you are located. Different from many other sites you might stumble upon, Rocket Lawyer offers much more than a Last Will and Testament template. If you ever need support from a lawyer, your membership provides up to a 40% discount when you hire an attorney.

  • Would I need to take additional actions once I have drafted a Montana Last Will and Testament?

Your Montana Last Will has a series of directions that you will need to follow to finalize the document. With a Premium membership, you may edit, save it in Word or PDF format, or sign it. Even if you make copies, take care to keep your signed original in a safe place where it can't get wet or otherwise damaged. It is important that someone you trust knows where it can be found after you pass away.

  • Does a Last Will and Testament need to be notarized or witnessed in Montana?

The requirements and restrictions for Wills will vary in each state; however, in Montana, your document requires two witnesses. As a general standard, your witnesses must be mentally competent individuals. Furthermore, it is recommended that your Last Will be signed by a notary public in order to help reinforce its legitimacy.

  • Does a Last Will and Testament need to be filed in Montana?

A Last Will and Testament doesn't need to be filed until the testator passes away. Filing a Last Will (along with any other forms required by the county) allows for the probate process to begin.
