Notice to Person Executing Power of Attorney:

A Power of Attorney is an important legal document. By signing the Power of Attorney, you are authorizing another person to act for you, the principal. Before you sign this Power of Attorney, you should know these important facts:

Your Agent (attorney-in-fact) has no duty to act unless you and your Agent agree otherwise in writing.

This document gives your Agent the powers to manage, dispose of, sell and convey your real and personal property, and to use your property as security if your Agent borrows money on your behalf, unless you provide otherwise in this Power of Attorney.

Your Agent will have the right to receive reasonable payment for services provided under this Power of Attorney unless you provide otherwise in this Power of Attorney.

The powers you give your Agent will continue to exist for your entire lifetime, unless you state that the Power of Attorney will last for a shorter period of time or unless you otherwise terminate the Power of Attorney. The powers you give your Agent in this Power of Attorney will continue to exist even if you can no longer make your own decisions respecting the management of your property, unless you provide otherwise in this Power of Attorney.

You can change or correct the terms of this Power of Attorney only by executing a new Power of Attorney, or by executing an amendment through the same formalities as an original. You have the right to revoke or terminate this Power of Attorney at any time, so long as you are competent.

This Power of Attorney must be dated and must be acknowledged before a notary public or signed by two witnesses. If the Power of Attorney is signed by two witnesses, the witnesses must be mentally competent and they must witness the principal's signing of the Power of Attorney or (2) the principal's signing or acknowledgment of his or her signature. A Power of Attorney that may affect real property should be acknowledged before a notary public so that it may easily be recorded.

You should read this Power of Attorney carefully. When effective, this Power of Attorney will give your Agent the right to deal with property that you now have or might acquire in the future. The Power of Attorney is important to you. If you do not understand the Power of Attorney, or any provision of it, then you should obtain the assistance of an attorney or other qualified person.

  • How do I get a Montana Power of Attorney form online for free?

    1. Make your PoA - Answer a few simple questions and we will do the rest
    2. Send or share it - Look over the PoA with your agent or seek legal help
    3. Sign it - Mandatory or not, witnesses and notarization are recommended

This route is, in many cases, notably more affordable than finding and working with a traditional lawyer. If needed, you can fill out this PoA on behalf of your spouse or another relative, and then have them sign it when ready. Keep in mind that for a Power of Attorney to be legally valid, the principal must be a mentally competent adult when they sign. If the principal has already been declared incompetent, a conservatorship generally will be required. When facing such a situation, it's important to speak to an attorney .

  • Why should I have a Montana PoA?

Every adult should have a Power of Attorney. Although it's painful to acknowledge, there could come a time when you can no longer make your own decisions. There may even be times when you're simply out of reach. Common occasions where you may find a PoA to be useful include:

    • You are planning to travel or live overseas either temporarily or permanently
    • You are aging or dealing with limited mobility or ongoing health issues
    • You intend to move out of your home and into a residential care facility
    • You would like to grant a trusted person the ability to manage specific financial or legal matters in your absence or if you become ill

Regardless of whether this Montana Power of Attorney is being produced as a result of an unexpected emergency or as part of a long-term plan, witnesses and notarization can often help to protect your document if a third party doubts its credibility.

  • Which type of Power of Attorney do I need in Montana?

There are several different ways to classify Power of Attorney documents. They are largely dependent on how long the powers will be in effect, when they come into effect, and what they offer authority over. Frequently, you may see them separated into the four buckets below:

    • Special Power of Attorney - Grants a limited scope of powers over specified matters
    • General Power of Attorney - Grants a broad scope of authority over your affairs
    • Springing Power of Attorney - Comes into effect based on certain criteria
    • Durable Power of Attorney - Remains valid even when you become mentally incompetent or otherwise incapacitated

When generating your free Montana Power of Attorney with Rocket Lawyer, you can elect to have the power begin immediately, on a selected date, or only at the point when you are no longer capable. Your Power of Attorney may end on a particular date or when you pass away.

  • Do I need to work with an attorney for my Montana PoA?

Montana Power of Attorney forms are usually straightforward, but you or your agent(s) may still need advice. The cost of meeting and hiring a conventional law firm to produce a Power of Attorney could add up to anywhere between two hundred and five hundred dollars. Rocket Lawyer offers much more than other Power of Attorney template providers that you may come across elsewhere. As a Rocket Lawyer member, you can get up to a 40% discount when hiring an Rocket Lawyer network attorney.

  • Will there be any next steps that I should be sure to take after creating a Montana Power of Attorney?

Attached alongside each Power of Attorney form, there is a list of directions that you'll need to finalize the document. Feel free to interact with the document in any or all of the following ways: making edits, downloading it in PDF format or as a Word document, printing it, and signing it. Finally, you should be sure that your agent(s) and financial institutions get a copy of the fully executed document.

  • Does a Power of Attorney need to be notarized, witnessed, and/or recorded in Montana?

The specific requirements and restrictions for PoA forms will be different in each state; however, in Montana, your document will need the signature of a notary. If your agent will have the authority to manage real estate transactions, the Power of Attorney will need to be signed before a notary and recorded with your county.
