Learn more about Power of Attorney

A Power of Attorney (POA) gives permission to another person or entity (your agent) to act on your behalf in legal matters (e.g. property, financial or medical affairs). You can allow your agent to write, sign official documents, or handle other affairs.

Making a free Power of Attorney online is simple. Just answer a few questions, and Rocket Lawyer will build your document for you. Consider these questions beforehand to make the process speedier:

  • Who will you designate as your agent, co-agent, and alternate agent?
  • Would you like to grant your agent broad or specific powers?
  • Will your agent have authority over any of your assets, businesses, trusts, or real estate?
  • Will your agent be compensated?

If you don't have all of the details you need, you can skip questions, and save your document for later.

A Power of Attorney can be general (granting broad powers over your affairs) or it may be special (allowing your agent power only over specific situations.) With Rocket lawyer, you can also choose to make your document durable, meaning that your agent's powers remain in effect even if you become incompetent or incapable of handling your affairs.

A General Power of Attorney ends when you become incapacitated. Contrastingly, a Durable Power of Attorney contains specific language which maintains your agent's authority even if you are unable to communicate or make decisions for yourself.

Typically, a Power of Attorney cannot grant the agent the ability to:

  • Change the principal's will.
  • Change or transfer Power of Attorney to another person.
  • Break their fiduciary duty to act in the principal's best interest.
  • Make decisions on behalf of the principal following their death, with a few exceptions. Ask a lawyer if you would like to know more about these exceptions.

On average, a lawyer can charge you anywhere between $175 and $300 depending on what state you live in. With Rocket Lawyer, you can make a Power of Attorney for free.

You can access your Power of Attorney anytime, anywhere, on any device. As a Rocket Lawyer Premium member, you can download it in PDF or Word format, and print it anytime. You can also use your Rocket Lawyer membership to have your Power of Attorney reviewed by an On Call attorney.
