Some states use both charges and differentiate between them, with DUI signifying a relatively lower degree of intoxication than a DWI. Some states just use one term or the other without a distinction of degree of intoxication.

Do I have the legal right to refuse a field sobriety test?
Although laws vary by state, generally you are not legally required to take a field sobriety test. Refusing a field test, however, might give the officer another reason to suspect intoxication and may not prevent an arrest.
