Free Certification of Living Trust

1. The Certification of Living Trust document should be signed in the presence of a notary public.

2. Be sure to attach copies of the relevant pages of the trust agreement to the Certification of Living Trust document. Review the certification to verify that you have attached the correct pages that contain the trust provisions that you referenced in the certification.

3. The trustee(s) should provide the original copy of the certification to the third party and should retain a copy with the other important records for the trust.

Third parties who request a trust certification vary in what they request. Sometimes copies of trust provisions are requested without the requirement of a certification. They do not always request the same provisions.

• In almost all cases, you must provide the first page which shows the establishment of the trust.

• The first page usually shows the identity of the initial trustee(s).

• Some third parties want to see the provisions of the trust that explain how successor trustees are selected.

• In some cases, the provisions which reserve the rights to revoke the trust and/or to change or amend its provisions are required. Often this provision is on the first page, but not always.

• The third party may require copies of the general administrative provisions that show the powers of the trustee(s).

• In almost all cases, the signature page(s) must be provided to show that the trust agreement was actually signed.
