When and How to Update Your Power of Attorney

You should update your Power of Attorney when your life circumstances change significantly, or when you need to appoint a new agent.

When to Update Your Power of Attorney
You should update your Power of Attorney in the following situations, for example:

  • You have married, and want to designate your spouse as your agent.
  • You have divorced or become separated from your former spouse.   Since it's likely that your spouse was your appointed agent, you'll want to name a new agent.
  • Your appointed agent is deceased, incapacitated or is otherwise unable to handle the responsibility of being your agent.
  • You no longer trust or have confidence in your agent's ability to handle your finances.
  • There are changes in your state's laws which affect the legality of your Power of Attorney document.

How to Update Your Power of Attorney

If you have an existing Power of Attorney document and you need to make changes, you should revoke your current Power of Attorney first.  You can revoke your power of attorney with the RocketLawyer.com Revocation of Power of Attorney document. Then, simply create a new Power of Attorney that includes the necessary changes.
